Heather Nagel, Executive
Director and co-founder of Heaven Can Wait rescued over a thousand
animals from death and euthanasia. She treated hundreds for
various illnesses. In the six years that Heaven Can Wait was
in operation, there was NOT ONE complaint about ANY
animal in the care of Heaven Can Wait, under the direction of
Heather Nagel. NOT ONE complaint from any of the
numerous Veterinarians utilized. NOT ONE complaint from
any Emergency Animal Hospital. NOT ONE complaint from
any volunteer. NOT ONE complaint from PetSmart, where
animals were shown. NOT ONE complaint from Pet Supplies
Plus, where animals were shown. NOT ONE complaint from
any person who adopted an animal. NOT ONE complaint
from a City of Akron Dog Warden who frequently visited the Heaven
Can Wait House. NOT ONE complaint from ANY
neighbor of the Heaven Can Wait House.
THERE WERE ABSOLUTELY NO
COMPLAINTS FROM ANYONE, EVER, REGARDING THE CARE HEATHER NAGEL
GAVE TO THE ANIMALS.
What you are about to read is
an atrocity against Heather Nagel. Who was involved
against Heather Nagel? Karen Conklin, Executive Director
of the Humane Society of Greater Akron (Pawsibilities). Lisa Holland-Toth,
President of One of a Kind Pets, the Veterinarians utilized by the
Humane Society of Greater Akron and One of a Kind Pets, Shannon
O'Herron and Tim Harland, Humane Officers from the Humane Society of
Greater Akron (Pawsibilities), City of Akron Prosecutor Craig Hanus,
City of Akron Visiting Judge Michael Weigand. Who was behind
the attack against Heather Nagel? Could it be Akron Mayor
Plusquellic, who Heather and her father, WNIR talk show host Tom
Erickson were frequent critics of? Could it be Akron Mayor
Plusquellic , who Heather was very active in a recall against.
Could it be Akron Mayor Plusquellic, who has a rubber stamp City
Council and Heather announced her candidacy less than two weeks
before the raid? |

On July 14th, 2009, the
City of Akron health department came, unannounced, to the
Heaven Wait House because of existing coding violations.
Because they knew Heaven Can Wait had dogs and cats inside, they
contacted the City of Akron animal control. They had a
pole to break down the door. A neighbor contacted
Heather Nagel and Pat Mihaly, operators of Heaven Can Wait, about
the situation. Upon arriving, there were numerous police cars
and the City of Akron. Heather Nagel opened the door, and the
City went inside. They came before the daily cleaning of
animal kennels, which like the Summit County Animal Control Facility
and Humane Society of Greater Akron (Pawsibilities), needs attention. The
house did have too many dogs, which was addressed later as kennel
violation charges and pled guilty to in court. There was
a odor of urine, as the kennels did not have their daily cleaning
yet. The City of Akron contacted the Humane Society
(Pawsibilities) because of the amount of dogs and cats. When Humane Society of
Greater Akron (Pawsibilities) Humane Officer's Shannon O'Herron and Tim Harland
arrived, they too complained about the strong ammonia urine smell,
which again was due to the fact that the cages were not cleaned yet.
These Humane Officers should have been aware of this because the
Humane Society of Greater Akron (Pawsibilities) and Summit County Animal Control
Facility encounter similar situations on a daily basis.
The City of Akron declared
that there was feces on the floor. Photos they took will prove
that there was no feces on the floor, except for a little pile on
the landing going to the upstairs, which was obviously deposited
overnight by one of the little dogs running loose. What
they did see was food on the floor. Heaven Can Wait had
numerous volunteers at the house weekly, and none ever saw feces on
the floor, except for an occasional accident, which was promptly
picked up. A City of Akron Animal Warden was a frequent
visitor inside the Heaven Can Wait House. He never saw feces
on the floor. He never saw neglectful conditions.
Several weeks prior, the house
had a main line sewer backup in the basement. At the time of
the sewer backup, Pat Mihaly was at the house. She promptly
went to the basement, shoved the several cages of dogs out of the
path of the overflow, and began to throw things also out of the path
of the overflow. When the City of Akron descended into
the basement, they saw the dog's cages shoved to the middle of
the room. They saw items thrown around. What they forgot
to tell the public is that there was trash bag upon trash bag in
piles from the clean up. There were shovels, brooms, mops and
cleaning supplies.
The City of Akron condemned
the house because of the sewer, which was not totally unclogged yet.
At that point, the Humane Society of Greater Akron decided to take
all of the animals. At that point! None of the animals
were looked at by Humane Officers Shannon O'Herron or Tim Harland
when the decision was made to remove the animals. The animals
were being removed because the City of Akron condemned the house due
to the sewer backup, NOT because they had concerns about the
condition of the animals.
Alot of the animals were taken
directly to the Humane Society of Greater Akron (Pawsibilities) , on Quick Road in
Peninsula. Television crews from both News 19 and Fox 8
went there and watched as the Heaven Can Wait dogs and cats were
unloaded. Both the News 19 cameraman and the Fox 8 reporter
said that the animals looked very good.

When the Humane Society of Greater Akron
(Pawsibilities) took Heaven Can
Wait's animals on July 14th, Attorney Warner
Mendenhall's office made numerous phone calls and emails
to have an independent Veterinarian exam each animal.
Karen Conklin, the Executive Director of the HSGA
refused to return the calls and emails. All animal
exams were performed by their Veterinarian and One of a
Kind Pets (Lisa Holland-Toth, President and Founder) Veterinarian. You will read later
how the allegations did not match the Veterinary exams
and that Veterinary records were falsified and tampered
with. (pictured below is Karen Conklin,
Executive Director of the Humane Society of Greater
Akron (Pawsibilities), and Lisa Holland-Toth, One of a Kind Pets)

when taken from Heaven Can Wait, and then the

HSGA evidence photograph of the same dog, hours
after taken from Heaven Can Wait, shows the
legs covered with urine from being kept in a carrier
for a prolonged time. The urine covered fur
was caused by the Humane Society of Greater Akron (Pawsibilities),
not Heaven Can Wait.

When Humane Society of Greater Akron
(Pawsibilities) Humane Officers
Shannon O'Herron and Tim Harland were taking away
animals from the Heaven Can Wait House on July 14th, Pat
Mihaly and Heather Nagel asked numerous times if they
wanted the animal's medical records, since some were
being treated for ailments. Tim Harland and
Shannon O'Herron stated that they did not want the
medical records (numerous witnesses). Yet, under
oath, on the witness stand at the trial, both Shannon
O'Herron and Tim Harland lied by stating that Pat Mihaly
and Heather Nagel refused to give the records.

stated: "... this is almost
unreal....and as you know I was at the hcw
house the day of the raid. I heard you
a couple times at least try to give the
medical records but they were refused...I
cant believe something like this was allowed
and is allowed to be happening" |

On the day/day
after the Humane Society of Greater Akron (Pawsibilities) and One of
a Kind Pets took Heaven Can Wait animals, the Humane
Society of Greater Akron was contacted by Attorney
Warner Mendenhall's office, informing them that
Heather Nagel wanted to bring a truckload of food
for all of Heaven Can Wait's animals. Heaven
Can Wait has several storage units full of dog and
cat food. Karen Conklin, Executive Director of
the Humane Society of Greater Akron (Pawsibilities), nor anyone else
from the HSGA returned the calls. Instead,
Karen Conklin publically pled for donations for food
for Heaven Can Wait animals. Was Karen Conklin
being an opportunist and was she taking advantage of
the media attention, when food was ready to be
brought there for the animals?

- The media stories that aired
showed the Heaven Can Wait animals in a nice little
house, located at the Humane Society of Greater
Akron (Pawsibilities).

- When the media attention was
over, the Humane Society of Greater Akron (Pawsibilities) moved alot
of the dogs here. The storage area of their
condemned, rodent infested, unheated, unsanitary,
barn.

The Humane
Society of Greater Akron (Pawsibilities) took the animals because of
the "conditions" of the the Heaven Can Wait house.
The HSGA is supposed to set the standard of care.
Over and over, Prosecutor Craig Hanus brought up
that the animals were in deplorable conditions.
The Heaven Can Wait dogs were put into a condemned
barn. There is no heat, it is rodent infested
(see HSGA enlarged photo below of mouse trap), had
to lay on filthy, unsanitary straw, in deplorable
conditions. Many of Heaven Can Wait's dogs
were put into the storage section of the barn.
Neglect? Cruel? Lag in standard of care?

Next is a
photo taken while the Heaven Can Wait dogs, and
others, were housed in the middle of winter, in an
unheated barn at the Humane Society of Greater
Akron (Pawsibilities). Not only is this barn unheated, but
there is either no door, or it was left open.
Neglect? Cruel? Lag in standard of
care?

One
week later, Judge Weigand ordered 94 or the 106 taken
animals returned to Heaven Can Wait because there was no
probable cause to have taken them. The animals
were in optimal health, with no signs of alleged abuse.

The
Humane Society of Greater (Pawsibilities) Akron demanded that in order
for them to return Heaven Can Wait's animals, Heaven Can
Wait would have to pay them $30,000. Heaven Can
Wait did not have the extortion amount of $30,000, and
had to surrender the animals.

It is
interesting that the demand was for $30,000.
Almost the exact amount that a Humane Society of
Greater Akron (Pawsibilities) employee stole from them, at about the
same time. It is also interesting that while
Heather Nagel was being held responsible, by City of
Akron Prosecutor Craig Hanus, for the alleged animal
abuse because she was Heaven Can Wait's Executive
Director, why wasn't Karen Conklin, Executive
Director of the Humane Society of Greater Akron (Pawsibilities) held
responsible for the theft occurring under her watch,
as she is the Executive Director. Double
standards?

- The cat that had it's
tail amputated by the Humane Society of Greater Akron's
(Pawsibilities) partner in the taking of Heaven Can Wait's animals, One
of a Kind Pets, had already been examined by a
Veterinarian. It was determined that the cat had
nerve damage and did not have have control of it's
bowels. These records were made available to
Humane Officers Shannon O'Herron and Tim Harland, which
they refused to take. The Heaven Can Wait Vet that
examined the cat said that removal of the tail was optional, and that if it was removed, the cat would
have to wear a diaper. The other option would be
to wipe the cats anus area daily to remove feces.
Heaven Can Wait opted to have the tail not removed, and
to leave the option open for whoever might adopt it,
with Heaven Can Wait paying for the removal.

- In addition, Humane Officer
Tim Harland lied, under oath, July 21st at the
Probable Cause Hearing by stating that this cat's
tail was infected. The One of Kind Pets
medical record for this cat after taken from Heaven
Can Wait, shows that the tail was not infected.
Not only did Humane Society of Greater Akron (Pawsibilities) Tim
Harland lie, but this lie was published in the Akron
Beacon Journal.
- The Humane Society of Akron
(Pawsibilities) filed charges because they said that this cat was
underweight. Their own intake photo shows
otherwise.

- The Humane Society (Pawsibilities) filed
charges because they stated that this cat was feces
covered. Their own intake photo shows that
this cat is very white.

- The Humane Society of Greater
Akron (Pawsibilities) filed charges on this dog because it allegedly
had a flea allergy and had a low BMI (Body Mass
Index). When looking at the photos provided,
the first photo was the intake photo at the Summit
County Animal Control Facility. Please note
the SEVERE discoloration on it's rear back.
This discoloration was from blood, from a flea
allergy. The second photo was taken by the
Humane Society of Greater Akron (Pawsibilities) as "evidence".
Please note how much the allergy was clearing up
under the care of Heaven Can Wait. In fact,
this dog was featured on a local television show
(3rd Photo). The dog had the same BMI the day
it was taken from Heaven Can Wait, as when it was neutered at One of a
Kind Pets. One of a Kind Pets is the one who
provided animal cruelty allegations on an animal
they already determined had a normal BMI, and
without knowing how the dog came from the pound in
much worse condition. Had Humane Society of
Greater Akron (Pawsibilities) Humane Officers Shannon O'Herron and
Tim Harland not refused the medical records from
Heaven Can Wait, the HSGA and One of a Kind Pets
would have known.

Humane Society of Greater Akron (Pawsibilities) alleged animal abuse
because they claimed this dog had fleas. Their
photo was enlarged. The dog had no fleas.

addition, The Humane Society of Greater Akron
(Pawsibilities) claimed that the Heaven Can Wait animals did not
receive flea treatments. Their photo of the

be seen

- Humane Society of Greater
Akron (Pawsibilities) alleged that the Heaven Can Wait animals had
no flea treatment. Below are enlarged HSGA intake photos showing flea collars put on
by Heaven Can Wait.

- The Humane Society of Greater Akron
(Pawsibilities) Humane
Officer Tim Harland, stated, under oath, that the dogs
taken had fleas. Yet, the medical documentation
from the Humane Society of Greater Akron showed that
none of the animals, for which records were provided
(the alleged abused ones), received flea treatment
for at least seven (7) days, which means they arrived at
the Humane Society of Greater Akron, directly from
Heaven Can Wait, with no fleas.

- The Humane Society of
Greater Akron (Pawsibilities) alleged that the dogs were receiving no
flea treatment. Photos, taken by the Humane
Society of Greater Akron (Pawsibilities), of numerous dogs, not only
showed numerous dogs with flea collars on, but with an
indentation of where the collar was removed (tampering
with evidence).

- The Humane Society of
Greater Akron (Pawsibilities) had filed charges for one of the dogs
claiming it had urine burns from standing in a cage,
with urine in it, too long. This dog was received
by Heaven Can Wait on July 12th, two days before the
raid. The Veterinarian stated, under oath, that a
dog can not get urine burns from two days of exposure.
The first photo was taken by Heaven Can Wait when
they got the dog two days before it was taken
by the Humane Society of Greater Akron (Pawsibilities). Note
the excellent condition of it's paws.

- The Humane Society of Greater
Akron's (Pawsibilities) intake photos of the dogs feet AFTER they
took it. In addition, why is the Humane
Society of Greater Akron (Pawsibilities) walking this dog on gravel,
which is not only painful to a dog's paws, but can
damage them.

- The Humane Society of Greater
Akron (Pawsibilities), HSGA, filed charges against Pat Mihaly and
Heather Nagel because one dog had demodectic mange.
Had Humane Officers Shannon O'Herron and Tim Harland
not refused to accept the medical files from Pat
Mihaly and Heather Nagel on the day the Humane
Society of Greater Akron (Pawsibilities) took Heaven Can Wait's dogs
and cats, they would have seen that the dog was
being treated for demodectic mange.

The Humane
Society of Greater Akron (Pawsibilities), HSGA, did not know that
one of the other dogs they took from Heaven Can Wait
was a sibling of the demodectic mange dog.
After the HSGA took the animals, the dog pictured
here showed the symptoms of it's sibling.
Should the Humane Society of Greater Akron (Pawsibilities) be
charged with Animal Cruelty because a dog became
symptomatic of demodectic mange while in their care,
like they charged Pat Mihaly and Heather Nagel?
The photo below shows the Petfinder.com ad for this
dog, where the Humane Society of Greater Akron
(Pawsibilities) states: "Azura is being treated for a
non-contagious skin issue".

- The Humane Society of
Greater Akron (Pawsibilities) had filed charges for another dog stating
that it was underweight. The same dog had been
examined and neutered by One of a Kind Pets previously
being the same weight. One of a Kind Pets made the
allegation that the dog was underweight, but it was not
an issue when One of a Kind Pets examined and neutered
the animal.

- The Humane Society of
Greater Akron (Pawsibilities) claimed that this same dog had fleas, yet
they did not give any type of flea treatment for over a
week. Thus, the animal came in with no fleas.
They also shaved the dogs tail because of a rash.
Under oath, a Veterinarian stated that this type of rash
was very common, and hard to treat, in the breed of dog.

Greater Akron (Pawsibilities) filed charges because one of the dogs had
mange. Had Humane Officers Shannon O'Herron and
Tim Harland not refused the medical files, they would
have seen that this dog was being treated for mange.

Akron (Pawsibilities) was compared to the intake photo of Heaven Can
Wait. The dog showed vast improvement while in
Heaven Can Wait's care.

- One of a Kind Pets provided
medical records as evidence. One such document
(will be scanned for viewing later), when compared
against the carbon copy document One of a Kind Pets
provided to Heaven Can Wait, clearly showed that there
were additional notes added to the original, which were
not on Heaven Can Wait's copy. One of a Kind Pets
falsified documents.

- The Humane Society of
Greater Akron (Pawsibilities) filed charges because one dog had a tumor.
Had Humane Officers Shannon O'Herron and Tim Harland not
refused the records, they would have seen that this dog
was rescued from the Ashtabula Dog Pound right before a
mass euthanisia. Heaven Can Wait requested the
most unadoptable one. Thus, the dog with an
inoperable tumor. Why inoperable? Had the
Humane Society of Greater Akron (Pawsibilities) not refused the medical
files from Heaven Can Wait, they would have seen that
this dog also had a Grade 5 heart mummer, which made
putting him under anesthesia not possible.

- Judge Weigand refused to
permit a key witness for Heaven Can Wait testify.
A very reputable Akron Dog Warden who, in the
past, had testified on the behalf of the City of
Akron prosecution. He had been inside of the
Heaven Can Wait House numerous times before the raid.
Had he seen "deplorable" conditions, by law, he would
have had to have reported it. This warden had
brought to Heaven Can Wait one puppy that was
skeletal, and could barely walk. He had taken
it to the Humane Society, but they were going to
euthanize it, and he knew that Summit County Animal
Control would also euthanize it. This witness
had alot of to state, on behalf of Heaven Can Wait,
but Judge Weigand, again, refused to permit him to
testify. Below is the City of Akron, Animal
Control Warden with a puppy he brought to Heaven Can
Wait, fearing it may get Parvo at the Summit County
Animal Control Facility.

- The Humane Society of
Greater Akron (Pawsibilities) made an issue that the dog cages did not
have water bowls in them. This is a common
practice in shelter type environments. Photos of
the Humane Society of Greater Akron (Pawsibilities) show no water bowls
in the cages. In fact, in the Akron Beacon Journal
article dated November 5, 2009, "They use the same
tactics mothers and fathers employ when they tuck their
children into bed each night. There is a bedtime
snack. A drink of water". By their
own admission, the Humane Society of Greater Akron (Pawsibilities) partakes in
the same practice for which they condemned Heaven Can
Wait.

- The
Heaven Can Wait House was "condemned" due to a sewer
backup, which was remedied and files closed. The
Humane Society of Greater Akron (Pawsibilities) has kept animals in this
condemned, rodent infested, unsanitary, unheated barn
for over 18 years.

- This
dog was kept in his own, heated, clean room at the
Heaven Can Wait House. Karen Conklin, Executive
Director of the Humane Society of Greater Akron (Pawsibilities), ordered
the Heaven Can Wait animals removed. This is where
the dog she ordered removed was kept at the Humane
Society of Greater Akron (Pawsibilities). The condemned, rodent
infested, unheated, unsanitary barn.

- A Court Order was issued that
the Humane Society of Greater Akron (Pawsibilities) was NOT to adopt
out dogs from a list given, with photos. These
dogs had pre-arranged adoptions. The Humane
Society of Greater Akron (Pawsibilities) IGNORED the Court Order,
and allegedly adopted out the dogs. One of
which is the St. Bernard. This dog may have
gone to another rescue. The Humane Society of
Akron (Pawsibilities) has stated that this dog has gone to another
rescue, while City of Akron Prosecutor Craig Hanus
states the dog has been adopted. Just who is
telling the truth and who is lying? Or are
they both lying?

Heaven Can Wait paid for him to have him treated.

What City
Prosecutor Craig Hanus calls "propaganda" is fact and condemns
Heather for exposing the Summit County Animal Control Facility
tossing dead animals into a dumpster in plain public view. What
kind of demented, sick individual would not see something wrong
with dead animals flung into the air? What kind of monster is
the City of Akron taxpayers paying for?
Watch the

Heather Nagel explains the vast amount of restitution she made
to Heaven Can Wait, yet Mr. Hanus says "the State does not agree
that Miss Nagel knows did she anything wrong". Maybe,
Prosecutor Craig Hanus, it is because Heather DID NOTHING WRONG.
The evidence, and Heather's witnesses PROVED she did NOTHING
wrong. Your witnesses, LIED on the witness stand, and
could be proven!
